A deputy approached two men walking in the middle of Whippoorwill Lane in North Naples on Tuesday evening to warn them of their safety violation.
One of the men, Terris Omega Bentley, 19, took something out of his pocket and threw it on the ground, sheriff's reports say.
When the deputy asked him why he littered, Bentley said he was finished eating a package of Big Mama Sausage he purchased at the Race Trac on Pine Ridge Road. Since the discarded sausage was barely eaten the deputy decided to speak with the clerk at Race Trac.
The clerk confirmed that the two men had just been in the store, but they only purchased cigarettes.
Deputies arrested Bentley, 3125 La Costa Circle, North Naples, and charged him with petty theft.
