UPDATE: Jose David Giracca was booked into the Collier County jail Friday following his release from Lee Memorial Hospital in Fort Myers.Giracca is charged with two counts of aggravated assault on a law enforcement officer.
A U.S. Immigration and Customs Enforcement hold has been placed on Giracca for an overstay on his visa. He will remain in custody.

The Collier County Sheriff’s Office has released the name of the subject involved in the shooting that occurred Nov. 14 at Gulf Gate Plaza. The subject’s identity is as follows:
Jose David Giracca
4113 Coconut Circle North, East Naples
Hispanic Male
Date of Birth 10/04/1978
The reason for the delay in providing this information was the fact that positive identification was necessary prior to release of the identity. The Sheriff’s Office was able to confirm the identity of Giracca today with the cooperation of Immigration and Customs Enforcement.
It should also be noted that Giracca is in the United States Illegally and has been in that status since 2006.
The Sheriff’s Office is currently working with federal authorities to contact the subject’s next of kin, who we believe are in Argentina.
