Nicholas Kosobucki, 24, is charged with aggravated assault, driving under the influence of drugs or alcohol, driving under the influence of drugs or alcohol causing damage to property or person, and leaving the scene of an accident.
Reports give this account:
Deputies were patrolling the parking lot of Vision Nightclub, 11901 U.S. 41 North, at about 1:30 a.m. when they saw a black Chevrolet back into a parked car and then pull forward. One of the deputies shined his flashlight at the car and announced that he was with the Collier County Sheriff’s Office. The car then began to pull away through the crowded parking lot.
The deputy repeatedly ordered the driver to stop the car as it drove erratically through the parking lot. Eventually the deputy hit the front passenger side window with his baton. At that point the driver directed the car toward two deputies in the parking lot and drove toward them. One of the deputies fired a shot through the windshield to stop the threat of being hit by the car. The driver managed to maneuver his way out of the parking lot and head south on U.S. 41. Deputies responding to the scene spotted the car and pulled it over in the parking lot behind the Watermark Grille, 11280 U.S. 41.
The driver, Kosobucki, had slurred speech. He was unconscious during much of the traffic stop. When he wasn’t asleep he alternated between being argumentative and lethargic.
Kosobucki was taken to Naples Community Hospital to be medically cleared before being turned over to deputies and arrested.
As is standard procedure whenever a deputy discharges a weapon, CCSO is conducting a criminal investigation to determine whether the deputy’s actions were justified and a parallel administrative investigation to determine whether the deputy followed the agency’s policies and procedures during the incident.
