Deputies: Teen Struck Boy In Face With Gun

CRIME LOCATION: outside Long John Silver’s restaurant, 3015 U.S. 41 E., East Naples

CRIME DATE: Friday, July 18, 2008

ARRESTED: Caleb Fernandez, 16, 803 Cardinal St., East Naples

WHEN: Sunday, July 20, 2008

CHARGES: Aggravated battery with a deadly weapon, committing a felony with a firearm, discharging a firearm in public

SUMMARY: Deputies say Fernandez struck another teen in the face with a handgun butt and then fired shots into the air in the restaurant parking lot around 3 p.m. Friday.

Arrest reports gave this account:

The 15-year-old victim told deputies that he and two friends were in the parking lot walking to the restaurant when he was confronted by Fernandez, who was leaving the restaurant.

Fernandez began to argue with the teen. The teen told deputies that the confrontation was over an incident that happened between him and Fernandez a few weeks ago.

Fernandez pulled out a 9mm semiautomatic handgun from his waistband and pointed it at the teen.

The teen told deputies that he tried to grab the gun away, but Fernandez pulled it back and struck him in the mouth with the gun butt.

Fernandez then pointed the gun in the air and fired a round.

The teen and his friends ran to their car. As they were pulling out of the parking lot they heard another gunshot.

Deputies on the ground and in the air searched for Fernandez immediately after the incident, but were unsuccessful. They located Fernandez in North Naples on Sunday and arrested him.
